The sudden arrival of divorce papers can be a jarring and disorienting experience, leaving you reeling from the shock. Confronted with a bewildering array of legal documents, the uncertainty of your future can be overwhelming.

Many questions arise as you struggle to come to terms with this new reality. What lies ahead? How do you survive this uncharted territory? This blog provides practical guidance and support to help you traverse this difficult period. Take a deep breath, and let’s embark on this journey together.

What should you do next?

Upon receiving divorce papers, your spouse may request that you execute an Acceptance of Service or Acknowledgment form, which confirms receipt of the documents. Should you decline to sign, the court may impose additional costs.

After receiving the summons and complaint, you have 21 days to file an answer with the court. You can fill out the answer form by hand or complete it online. Be sure to check the box indicating whether you agree with each statement in the complaint.

You may also want to consider making a counterclaim, a lawsuit filed by the defendant against the plaintiff. There’s no fee to file one in a divorce case. You may want to make a counterclaim to ask for things not included in the plaintiff’s complaint or to disagree with their requests.

It’s crucial to file an answer to the complaint. If you don’t, the court can enter a default judgment against you, which may involve decisions on property, debts and child custody.

Remember to file your answer with the court and serve the papers on your spouse or their lawyer. You must also file a Certificate of Service with every paper you file in court to prove that you’ve served the required parties.
